Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Compyute ("Company", "we", "us", or "our"), concerning your access to and use of the Compyute website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Provision of Services

Compyute provides cloud infrastructure services including Virtual Private Servers (VPS), Virtual Dedicated Servers (VDS), and Bare Metal Servers. We reserve the right to modify, suspend, or discontinue any part of our services with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.

3. User Accounts

To access our services, you must create an account. You agree to provide current, complete, and accurate information. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify Compyute immediately of any unauthorized use of your account or password.

4. Payments and Billing

All services are billed on a subscription basis (monthly or annually) in advance. By providing a payment method, you expressly authorize us to charge the applicable fees. If payment fails, we reserve the right to suspend your services until payment is successfully processed. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities.

5. Acceptable Use Summary

You may not use our services for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations applicable to your use of the services. Please refer to our complete Acceptable Use Policy (AUP) for detailed restrictions. Violation of the AUP may result in immediate termination of your account without refund.

6. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Governing Law

These Terms shall be governed by and defined following the laws of the jurisdiction in which Compyute is registered. Compyute and yourself irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
